We help you understand every facet, such as grounds for divorce, residency requirements, property division, child custody, child support, and spousal support.

Grounds for Divorce

In Illinois, you can file for divorce on either fault or no-fault grounds. Fault grounds include adultery, felony conviction, cruelty, or desertion. If you choose to file on no-fault grounds, this means that neither party is responsible for the dissolution of the marriage. You must be separated for one year, or six months if there are no minor children and you have a separation agreement, to file for a no-fault divorce.

Residency Requirements

To file for divorce in Illinois, at least one spouse must have been a resident for at least 90 days prior to filing. Military personnel stationed in Illinois for at least 90 days or more are considered residents for the purpose of filing for divorce.

Property Division

Illinois follows an “equitable distribution” model for property division in divorce cases. This means the court divides marital property fairly but not necessarily equally. Factors such as each spouse’s contributions to the marital property, the duration of the marriage, and each spouse’s financial circumstances are considered.

Child Custody

When deciding on child custody arrangements, Illinois courts prioritize the best interests of the child. They consider various factors, including the age and physical and mental condition of the child and each parent, the relationship between each parent and the child, and the willingness of each parent to support the child’s relationship with the other parent.

Child Support

Child support in Illinois is calculated using a specific formula outlined in the state’s child support guidelines. The formula considers the gross income of both parents, the custody arrangement, and the costs of health insurance and work-related child care.

Spousal Support

Spousal support, also referred to as alimony, is not an automatic entitlement in Illinois divorces. It is crucial to understand that the court’s decision on this matter is guided by a careful evaluation of several factors and is rooted in the overarching goal of fairness and financial stability post-divorce.

One of the key considerations is the duration of the marriage. A longer marriage often implies a greater intertwining of financial lives, which may necessitate spousal support to ensure a fair transition into post-marriage life. The standard of living established during the marriage also holds considerable weight in determining spousal support. The court seeks to prevent a drastic drop in the standard of living for either party post-divorce, particularly for the spouse who was financially dependent during the marriage. An attorney can help ensure your best interests are supported.
